Hardin County Sheriff Keith Everhart expressed concern about an Ohio Supreme Court ruling concerning railroads.
The ruling states that a railroad company can no longer be prosecuted for blocking a railroad crossing for more than five minutes.
The Ohio Supreme Court concluded that federal law preempts enforcement of the Ohio statute.
Sheriff Everhart stated that this will adversely impact public safety response in every aspect.
He added that he finds this to be a very troublesome situation all around.
Seneca County Sheriff Fredrick Stevens added that there will no longer be any “bite” to the barking or complaints when railroad crossings are blocked for long periods of time.
