Ohio Supreme Court Hears Appeal Case on State of Ohio vs. Bortree
On June 16th, The Ohio Supreme Court heard the appeal of Ralph Bortree, who was arrested in 2019 for the 1993 attack of a 19 year old Logan county woman who was abducted, raped, and then left for dead in rural Logan County.
Bortree’s attorney James Tyack argues the state waited too long to charge Bortree with attacking a woman 26 years ago, and that the law doesn’t specifically define a limit for being able to charge his client for attempted aggravated murder and its statue of limitations had expired.
Prosecutors say that Bortree can still be charged with attempted aggravated murder even though the statute of limitations for rape and kidnapping had expired.
The Ohio Supreme Court took the case under advisement and has yet to make a ruling.
