The old Surplus Building in downtown Kenton has been deemed a nuisance, and its days are now numbered.

An Agreed Judgement Entry and Consent Decree pertaining to a lawsuit filed by Dave Ridgon against the City of Kenton, and the city’s counter claim, was issued in Hardin County Common Pleas Court this week.

According to the entry, the Court shall enter a judgement in full on Kenton’s counterclaim and finds that the property is a nuisance pursuant to a Kenton codified ordinance.

As part of the agreement, Rigdon was given until the 1st day of May this year to demolish and reclaim the property.

On April 10, the city and Rigdon will touch base regarding the progress of demolition, and if the city is unsatisfied with the progress, the parties can confer as to whether more time is needed.

All court costs were ordered to be taxed to Rigdon.
