The attorney for a Mt. Victory man filed in Hardin County Commom Pleas Court that he plans to pursue self defense at the upcoming murder trial of his client.

Andrew McCafferty is facing charges of aggravated murder, murder, involuntary manslaughter, felonious assault and two counts of tampering with evidence in connection to a stabbing that claimed the life of James Collins in Mt. Victory on October 1, 2025.

In the recent filing, attorney Joel Spitzer provided notice of intent to assert self-defense or defense of others pursuant to Ohio’s Stand Your Ground law enacted in 2021.

McCafferty contends that his actions were necessary and reasonable under the circumstances to prevent injury or death.

His five-day trial is scheduled to start February 2.
