
A rural Roundhead man, who was arrested Monday evening May 26 on child pornography charges, will remain behind bars while legal proceedings against him continue.
Attorneys for 59-year Mark Butterman had requested that he be released during the proceedings, but Magistrate Judge Darrell A. Clay denied the motion in United States Northern Ohio District Court in Toledo.
The ruling was handed down on Friday (May 30).
Judge Clay cited several factors for denying the request including: the offense involves a minor, the weight of the evidence against Butterman is strong, he is subject to a lengthy period of incarceration if convicted and his release would pose serious danger to any person or the community.
The Judge also cited Butterman’s history of alcohol or substance abuse as a reason.
Butterman was indicted earlier this month on one count of receipt and distribution of child pornography.
The investigation was conducted by the FBI and the Hardin County Sheriff’s Office.
If convicted, Butterman faces a minimum of five and maximum of 20 years in prison.
